Terms and conditions

These terms cover two separate things: using this website, and the basis on which we carry out work. Sections 1 to 5 apply to anyone using the site. Sections 6 onwards apply if you instruct us to carry out works.

1. About us

This website is operated by VCNY Group Limited, registered in England and Wales under company number 12624177, registered office 71–75 Shelton Street, Covent Garden, London WC2H 9JQ. References to we, us and our mean VCNY Group Limited.

2. Using this website

By using this website you accept these terms. If you do not accept them, please do not use the site.

You agree not to use the site in any way that is unlawful, that interferes with its operation or security, or that attempts to gain unauthorised access to any part of it. You agree not to submit false information through our enquiry forms.

We may change or withdraw any part of the site at any time. We do not guarantee it will always be available or uninterrupted.

3. Content and accuracy

The content on this site is provided for general information about our services. We take care to keep it accurate but it does not constitute technical, legal or professional advice, and it should not be relied on as a specification.

Descriptions of services, materials, timescales and methods are indicative. What we will actually do on your site, and what it will cost, is set out in the written quotation we issue after a survey.

Photographs of completed work are illustrative and do not form part of any contract.

4. Intellectual property

All content on this site, including text, layout, graphics and photographs, is owned by or licensed to VCNY Group Limited and is protected by copyright.

You may view and print pages for your own use. You may not reproduce, republish or use our content commercially without our written permission.

Third party trade marks and logos appearing on this site remain the property of their owners and are shown for identification only.

5. Links to other websites

Where we link to another website, we do so for information. We have no control over those sites and accept no responsibility for their content or their handling of your data.

6. Quotations

• Surveys and quotations are free of charge and place you under no obligation.
• Quotations are valid for 30 days unless stated otherwise, because material prices move.
• A quotation is priced against the written scope it contains. Work outside that scope is a variation and is priced separately.
• Quotations assume reasonable access to the working area and, unless stated, assume ground and substrate conditions are as they appeared at survey.
• An enquiry through this website is not a contract. A contract is formed when you accept our written quotation and we confirm it.

7. Carrying out works

• We will agree dates, working hours and access arrangements with you before mobilising.
• We will supply site specific risk assessments and method statements, together with insurance and accreditation details, before works begin.
• You agree to provide safe access to the working area, and to tell us about anything relevant that we could not reasonably have seen at survey — buried services, asbestos, structural defects and similar.
• Programmes assume normal working conditions. Weather, particularly for surfacing, coatings and external works, can move dates. We will tell you as soon as we know.
• Where works uncover something that could not reasonably have been foreseen, we will stop, tell you what we have found, and agree the position with you before continuing.

8. Variations

Any change to the agreed scope will be confirmed in writing, with the cost and any effect on the programme, before it is carried out. We will not carry out additional work and invoice you for it without agreeing it first.

9. Payment

• Payment terms are set out in the quotation. Unless agreed otherwise, invoices are payable within 30 days of the invoice date.
• On larger projects we may agree a payment schedule or stage payments, which will be stated in the quotation.
• Prices exclude VAT unless expressly stated.
• We reserve the right to charge statutory interest on late payment under the Late Payment of Commercial Debts (Interest) Act 1998.

10. Liability and insurance

We hold public liability and employers' liability insurance. Certificates are available on request and are issued with quotations.

We are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or failing to use reasonable care and skill. We are not responsible for loss that is not foreseeable, or for business losses such as loss of profit, loss of business or loss of opportunity, except where the law does not allow us to exclude them.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.

Where you are a business, our total liability in connection with any contract is limited to the value of that contract, except as set out above.

11. Complaints

If something is wrong, tell us. Email admin@vcny.co.uk or call 0203 908 0035 and we will acknowledge it and set out how we intend to put it right. We would far rather fix a problem than have you live with it.

12. Governing law

These terms and any contract between us are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
